Q: What should you do after an auto accident?
A: 1. Stop. After an auto accident, you should immediately stop your vehicle. It is a crime to knowingly leave the scene of an auto accident.
2. Aid the injured. If someone is injured, help them. Call an ambulence or doctor or both. Do not move an injured person unless you are qualified to do so.
3. Take steps to protect the accident scene. Position flares or other items so that oncoming traffic is warned of the upcoming accident scene and can steer around the accident.
4. Call the police. I think it is very important to call the police to any accident scene. The police are trained accident investigators and will document relevant facts about the accident scene. They can be very useful in later testifying about the accident.
5. Document and preserve the evidence. Carry an accident form so that you can fill it out at the accident scene. Record the names, addresses and telephone numbers of all witnesses. If you have a camera or cell phone with a camera, take pictures of the accident scene and the people at the accident scene. Measure distance from points of reference to the accident locations, i.e. skid marks.
6. Do not talk about the accident. You should not discuss the accident with anyone especially the other driver or his insurance carrier. You do not have to discuss the accident with anyone with the possible exception of the police. Even if you feel you may be at fault, it is best not to make any statements about the cause of the accident. If questioned by the police, simply answer their questions about what occurred.
7. Contact your lawyer immediately. Your lawyer will act quickly to document the loss by gathering statements from witnesses, photographing the vehicle and securing a copy of the police report. He will protect your legal interest and advise you on how to best proceed.
